The Committee considered the proposed negative instruments and was content. With regard to pNeg(5)08, The Flood and Water (Amendment) (England and Wales) (EU Exit) Regulations 2019, the Committee agreed to write to the Minister to ask for a more thorough explanation of why the regulations are to be made on an England and Wales basis.

The Committee considered the instrument and will report to the Assembly in line with the recommendation that the Welsh Government uplifts the Regulations to be subject to the affirmative procedure.

The Committee took evidence from the Minister for Environment, Energy and Rural Affairs. The Minister informed the Committee that a further relevant meeting was taking place this week and an update would be sent to the Committee following that meeting.
